What is khula and what are your rights?

Khula is dissolution of marriage at the instance of the wife under Section 2 of the Dissolution of Muslim Marriages Act 1939 and the Family Courts Act 1964. The wife is generally required to return the Mehr (or an agreed portion) and the court issues a decree of dissolution, after which the Union Council issues the effective khula certificate.

Grounds and timeline

You do not need to prove fault to obtain khula — the court will dissolve the marriage if reconciliation is not possible. From filing to the court's decree typically takes 3–6 months. The Union Council then issues the effective certificate after the iddat period.
