Khula is the lawful right of a Muslim woman to seek dissolution of her marriage through the Family Court when she can no longer live with her husband within the limits of Allah. What is Khula?
Khula is judicial dissolution of marriage at the wife's request. The basis lies in the Hadees of Sayyida Jameela bint Abdullah (RA), where the Prophet ﷺ instructed her husband to accept the return of the garden she had received as Mehr and to release her with one Talaq.
In Pakistan, Khula is granted under the Dissolution of Muslim Marriages Act 1939 and the Family Courts Act 1964, after the West Pakistan Family Courts Rules empowered Family Courts to grant Khula even without the husband's consent — a major protection for women.
Valid Grounds for Khula
A woman may seek Khula on grounds including:
• Cruelty, physical or mental abuse.
• Failure of the husband to maintain her.
• Long absence or imprisonment of the husband.
• Impotency or serious illness.
• Inability to live within the limits of Allah — i.e. genuine incompatibility, even without proof of fault.
Step-by-Step Khula Procedure
1. Initial confidential consultation — we listen, advise on rights and discuss reconciliation where appropriate.
2. Drafting of the Khula petition (Plaint) with grounds, Mehr details and supporting documents (Nikah Nama, CNICs, photographs).
3. Filing in the Family Court of the district where the wife ordinarily resides.
4. Issuance of summons to the husband.
5. Pre-trial reconciliation efforts by the Court (mandatory).
6. Recording of evidence if reconciliation fails.
7. Decree of Dissolution of Marriage by way of Khula.
8. Effective certificate from the Union Council after the iddat period.
Mehr & Financial Rights
In Khula, the wife typically returns the Haq Mehr received from the husband as part of the dissolution. Dowry articles (jahez), gifts, gold and personal belongings remain her property. Children's maintenance and custody are decided separately under the Guardians and Wards Act 1890.
Custody of Children (Hizanat)
Under Pakistani law and Islamic jurisprudence, custody of minor children is generally awarded to the mother — sons up to about 7 years and daughters until puberty — unless the welfare of the child requires otherwise. The father remains the natural guardian and is responsible for maintenance.
