Legal Framework
Court Marriage in Pakistan is governed by the Muslim Family Laws Ordinance 1961, the Nikah-Registration Rules and Pakistan Penal Code provisions that protect the free consent of adults. The landmark judgment in Mst. Saima v. State (PLD 2003 Lahore 747) established that any sane adult Muslim woman has the right to marry of her own free will, with or without Wali consent under Hanafi Fiqh as adopted in Pakistan.
Who Can Have a Court Marriage?
• Both parties must be Muslim (for a Muslim Nikah-based court marriage).
• The girl must be 18 years or older and the boy 18 years or older (Sindh Child Marriage Restraint Act 2013 sets 18 for both in Sindh).
• Both must be of sound mind and acting on free will.
• Neither should be in an existing undissolved marriage that prohibits a new Nikah.
Documents Required
• Original CNICs of bride and groom.
• CNICs of two adult Muslim male witnesses.
• 6 passport-size photographs of each party.
• Proof of age (if CNIC is not available, B-Form / Educational certificate).
• If divorced or widowed: divorce certificate or death certificate of previous spouse.
• Mehr amount agreed in writing.
Step-by-Step Court Marriage Procedure

3. Performance of Nikah by a Certified Nikah Registrar with Ijab-o-Qubool, Mehr and signatures of two witnesses.
4. Issuance of the Nikah Nama, signed and stamped by the Registrar.
5. Submission of the Nikah Nama to the concerned Union Council for registration.
6. Application to NADRA for the Marriage Registration Certificate (MRC).
7. Optional protection petition in the High Court where required for the couple's safety.
